Terms of Service

These Terms of Service ("Terms") form a binding agreement between you (or the organisation you represent) and Foremesh Pty Ltd ("Foremesh", "we", "us") governing your access to and use of the Foremesh platform and website at foremesh.au ("Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.

Foremesh is a B2B market intelligence platform that aggregates and analyses publicly available project and tender data to help sales teams identify and engage with upcoming opportunities in the Australian construction, infrastructure, and resources sectors.

The Service is currently in early access. Features, pricing, and availability may change. We will provide reasonable notice of material changes.

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

You must not share your account credentials with others outside your licensed seat allocation.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Scrape, crawl, or systematically extract data from the Service beyond normal use;
• Reverse engineer, decompile, or attempt to extract the source code of the Service;
• Use the Service to transmit spam, malware, or other harmful content;
• Attempt to gain unauthorised access to any part of the Service or its infrastructure;
• Resell or sublicense access to the Service without our written consent.

All intellectual property in the Service — including software, design, data models, and aggregated intelligence — is owned by or licensed to Foremesh. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of any data you upload to the Service (e.g. CRM records, notes). By uploading data, you grant us a limited licence to process it solely to provide the Service to you.

The Service aggregates data from publicly available sources including government tender portals, industry registries, and news feeds. While we take reasonable steps to ensure accuracy, we do not warrant that information is complete, current, or error-free.

You should independently verify any information before relying on it for commercial decisions. Foremesh is not liable for decisions made based on information provided through the Service.

Paid plans are billed in advance on a monthly or annual basis. All prices are in Australian dollars (AUD) and inclusive of GST where applicable.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by Australian Consumer Law.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

To the maximum extent permitted by law, Foremesh's total liability to you for any claim arising from or related to the Service is limited to the fees you paid in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law, including guarantees relating to services.

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees when due, or if we reasonably believe your use poses a security or legal risk.

You may terminate your account at any time by contacting us or using the account settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

We may update these Terms from time to time. We will notify registered users of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
